Title: Custodial and Non Custodial Sanctions

Just wondering if we need to know the difference between the two for the exam.

Also, would Home Detention and Hospital Treatment Order be considered custodial or non custodial.

Both of them are aimed at rehabilitation, making it non custodial, but they are also aimed to punish the offender, making it custodial.

I would say no.
I did legal last year and never encountered this "custodial or non custodiall" thing.

these are tooooo specific. Don't get sucked up into these unnecessary areas. The study design does not say anything about these so don't learn them. Learn what you need to know and look at the study design and make sure you have covered the NECESSARY AREAS. If it said "name one philosophy to a sanction" then you could say rehabilitation and explain it. I doubt they'll ever expect you to know this custodial thing and even if they did, it would be outside their jurisdiction to do so because the study design never mentioned anything about this.
